Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the TooMany mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

TooMany is a photo management application that helps users organize and delete photos from their iOS devices. The App provides features including:

  • Photo browsing and organization through swipe gestures
  • Smart grouping of similar photos
  • Photo deletion and storage management
  • Duplicate and blurry photo detection

3. Photo Library Access

The App requires access to your device's photo library to function. By granting this permission, you authorize the App to:

  • Read and display photos from your library
  • Delete photos as directed by you
  • Analyze photo metadata for grouping and organization

Important: All photo deletions are permanent and cannot be undone unless you have a backup. You are solely responsible for maintaining backups of your photos.

4. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Maintain backups of important photos before deletion
  • Ensure you have the right to delete photos stored on your device
  • Not attempt to reverse engineer, decompile, or extract source code from the App
  • Not use the App in any way that could damage, disable, or impair the service

5. Privacy and Data

Your privacy is important to us. All photo processing occurs locally on your device. We do not upload, store, or transmit your photos to our servers. Please refer to our Privacy Policy for detailed information about data handling.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be error-free or uninterrupted
  • Defects will be corrected
  • The App is free from viruses or harmful components
  • Photo deletion decisions made by the App's algorithms will match your preferences

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TOOMANY, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PHOTOS, DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

You acknowledge that photo deletions are permanent and accept full responsibility for any photos deleted using the App.

8. In-App Purchases and Subscriptions

The App may offer in-app purchases or subscription services. All purchases are processed through the Apple App Store and are subject to Apple's Terms of Service. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Refunds are handled according to Apple's refund policies.

9. Intellectual Property

The App and all related content, features, and functionality are owned by TooMany and are protected by international copyright, trademark, and other intellectual property laws.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Apple App Store Requirements

This App is available through the Apple App Store. Your use of the App is also subject to Apple's Licensed Application End User License Agreement (EULA). In case of conflict between these Terms and Apple's EULA, Apple's EULA shall prevail.
